Braun Ability Van Giveaway
Doug Goddard from Joni and Friends of Central Florida sent us an article about a van giveaway.
If you read AbilityVoice regularly, then you already know about our Ultimate NASCAR Fan Sienna Rampvan. If you haven’t seen it, you can read all about it in this article. Today, we’re excited to announce the launch of the “Fan Van Giveaway” website. For the next 6 months, people from across the country will have the opportunity to win this unique handicap van. BraunAbility ramp vans already draw some attention when people see them in use in parking lots – wait ’til people get a load of this driving down the road!
Winning the van is pretty simple: just go to fanvangiveaway.com and fill out the online entry form. You can enter yourself or nominate someone else – the only requirement is the nominee must rely on a wheelchair for their daily activities. We’ll ask for your contact info and you’ll need to write a short story telling us about yourself or your nominee.
You’ll receive a confirmation email after you submit your entry. After September 1, 2009, a panel from BraunAbility, Toyota, Great Clips and Braun Racing will select the lucky winner. That’s all there is to it!

We have contacted the group that sent us the posting and will let you know what we find out. Hopefully we can get the right people on this to fix any problems and concerns. Thanks for the posting.

I sent an email to the friend that asked me to post the contest. That email was responded to by the management at Braun explaining why they asked most people to re-apply for the contest. Below is the email that was sent (and Braun ok’d me posting this for everyone):
Dear Greg;
Your concern is totally justifiable and I take full responsibility for it. I want to try and give a better explanation of why the contest rules needed to be changed.
This “contest” began when we simply wanted to give away the van to a deserving candidate. As a company, it was our first foray into any type of contest/giveaway, and unfortunately in our naïveté we neglected to do any legal research before initiating the event. Our attorneys advised us that it was simply impossible to complete the giveaway as planned, so the decision was made to suspend and redesign the contest.
Upon examination, the major flaw was that we set up the contest as a “nomination” process AND an essay contest, making it legally impossible to objectively choose a winner. The “nomination” dictated that we award the van to the person with the most entries, while the “essay” dictated we judge the winner based on the compelling nature and creativity of the story. To make the contest work legally we had to choose one or the other, and in the end we did not want this to be a “popularity” contest and felt the essay contest would give a better chance of the van being awarded to a deserving person.
Further, we had to limit the contest to entrants over the age of 13, to avoid violating the Children’s Online Privacy Protection Act. In short, what started as a good intention turned into a legal mess, and I am embarrassed to be responsible for it. It seems that it’s very difficult to “just give something away” with our legal system the way it is.
We were not able to modify the contest rules to satisfy all previous entrants, and I am truly sorry for the consequences. Nevertheless, I’m confident the rules we have put in place will result in the van being given to a deserving person. It is my hope that we have learned from our mistake and we can continue these types of donations in the future.

The giveaway has decided to change the rules during the promotion period and now previously eligible entrants are no longer eligible. Also, all previous submission/nominations are being dismissed and must be resubmitted in order to be considered for the giveaway! TERRIBLE!
