US Steel drops job offer because applicant has disability
TradingMarkets.com has a story about a lawsuit brought on by the EEOC on behalf of a disabled person who was denied employment. The Gary, Indiana plant put out a job offer to an applicant who passed all the requirements for the job. The applicant was then tendered an offer of employment and the person was instructed to go to a medical facility for a medical test. The test was not fully explained in the article, but was probably the typical drug testing that is required by most employers now. The medical facility evidently reported that the perspective employee was disabled and US Steel then sent a letter rescinding the job offer. The person then went o the EEOC to complain they were discriminated against and they agreed. A lawsuit was started and US Steel lost the suit. The EEOC is presently seeking damages against US Steel for it’s discriminatory practices in hiring.
There are a large number of employers that are bigots that hate the disabled. This problem exists not only in steel plants, but in high tech companies. One would think that the disabled would not have a problem getting a computer job because the only requirement is to sit at a desk and occasionally pick up the phone. That is not the case – many companies do not want people in wheelchairs to meet with customers because "it gives the wrong connotation to the customer about the company." What wrong connotation this brings up is baffling to say the least. It is quite obvious that the ADA, and other laws instituted at the state levels are critical to guaranteeing basic civil rights to the disabled. Just as there are people that hate African Americans or immigrants in general, there are people that hate the disabled because we exist.
If you have been discriminated against, get a good lawyer and sue. There is no reason to be treated like a second class citizen or to be forced to sit at the back of the bus because you use a cane. Just because you are stuck in a wheelchair does not mean that you cannot do a multitude of jobs at least as good as any able bodied person. If we don’t stand up for our rights. you can be guaranteed that those rights will be slowly taken away by those that hate you for merely existing.
